An individual may have committed an act for which a “waiver” is required to obtain nonimmigrant or immigrant status in the U.S. The act does not need to be criminal (although some criminal acts do require waivers); the individual could have misrepresented himself or herself to a U.S. official in the past, overstayed his or her legal status in the U.S., entered the U.S. without permission, or previously been deported from the U.S. Note that this is not a complete list of all the acts that could require a waiver.

A waiver can be applied for in Immigration Court, with Citizenship and Immigration Services, or abroad with a U.S. Consulate or Embassy. In most cases, a waiver is used alongside a petition to become a permanent resident in the U.S., to defend oneself against deportation, or to apply to enter the U.S. as a non-immigrant.
